Terms and Conditions

This page sets out the terms and conditions for parents or adult students (“Client”) using the services of Xinhua Mandarin Tutoring (“Business”).
By booking a tutoring session with us (not an initial consultation), you agree to the following:
1. Services
The Business connects students with experienced and qualified independent tutors for private online Chinese language lessons. We carefully vet every tutor through photo ID checks, background screening, and interviews to ensure quality and safety.
Sessions are delivered via Zoom.
The Business will make reasonable efforts to match students with suitable or preferred tutors and ensure continuity.
2. Scheduling
Clients are to schedule lesson times directly with Tutors. The Business cannot guarantee the availability of any tutor.
3. Payment Terms
Clients agree to pay for agreed sessions in advance via the Stripe payment link provided by the tutor.
4. Cancellations, Refunds, and Rescheduling
- General Refund Clause (Packs) For clients who have purchased lesson packs at a discounted hourly rate, the following policy applies to all refunds for unused lessons: Refunds for lesson packs are calculated based on the unused portion of the pack. However, all lessons already taken will be retroactively charged at the full, undiscounted, single-hour rate ($38 per hour) before the balance is refunded.

Business or Tutor Cancellation
If the Business or assigned Tutor cancels a scheduled session, the Client is entitled to:
- Reschedule at a mutually agreed time, or
- A full refund for the scheduled session, if payment was already made.

Client Cancellation (More than 24 hours notice)
If the Client cancels a session with more than 24 hours’ notice, the Client is entitled to:
- Reschedule at a mutually agreed time, or
- A full refund for the scheduled session, if payment was already made.

Client Cancellation (Less than 24 hours notice)
Lessons cancelled with less than 24 hours’ notice will be charged at 50%. If payment was already made, the client is entitled to a 50% refund for the session.
No free reschedule or full refund will be provided for late cancellations except in exceptional circumstances at the Business’ and Tutor’s discretion.
- No-Shows Failure to attend a scheduled lesson without prior notice is treated as a late cancellation and charged at 50%.
5. Conduct Expectations
Students are expected to behave respectfully and follow Tutor instructions during lessons.
The Business reserves the right to terminate services if a student behaves inappropriately or disruptively.
6. Technology Requirements
Clients must ensure they have a stable internet connection and access to a suitable device for online zoom lessons.
The Business is not responsible for technical issues on the client’s side.
7. Privacy and Child Safety
- The Business will protect student personal information in line with our Privacy Policy.
- Tutors will maintain professional boundaries and safe, respectful communication.
- Parents should report any concerns about tutor conduct immediately to the Business (see section 10 for information regarding how to confidentially contact the Business).
- In the case that the student is a child, lessons may be observed by parents.
8. Tutor and Business Privacy
- Recording, screenshotting, or distributing any part of a lesson without prior permission from the Tutor is prohibited.
- Students and parents agree to respect the confidentiality of all lesson content and the Tutor, and not to share Tutor details publicly without explicit permission.
- Students and parents agree not to attempt to hire Tutors directly or outside of this service without prior written consent from the Business and Tutor.
9. Limitation of Liability
- The Business acts as a facilitator connecting students with independent tutors.
- The Business is not liable for personal disputes or losses beyond the lesson fee.
- Nothing in this agreement limits rights under Australian Consumer Law.
10. Contacting the Business
Xinhua Mandarin Tutoring Services (the Business) is committed to providing a safe learning environment for all students and tutors. In the case that students have any questions, concerns, feedback, or requests, students can email students@xinhua.com.au. This email address is confidential, and cannot be accessed by any tutor.
11. Agreement and Changes
- By booking and paying for lessons, the Client accepts these terms.
- The Business may update these terms with notice to clients.
